Nothing in these terms and conditions affects the rights you have as a consumer under mandatory Dutch or European law. To the extent any provision of these terms conflicts with such mandatory statutory protections, those statutory protections continue to apply in full.

1. Applicability

These general terms and conditions apply to all purchases made through our webshop and form a binding agreement between you and AxionToolworks.

1. Products and Pricing

All prices include VAT unless stated otherwise. Product descriptions and images are for reference; minor variations may occur. Prices may change but will not affect orders already confirmed.

1. Ordering Process

An order is formed at the moment you place it through our webshop; we will confirm receipt of your order by email. This confirmation of receipt does not waive our right to still refuse or cancel the order for valid reasons as described below, nor does it retroactively undo an agreement that has already been formed: if we cancel an order after the agreement has been formed, you retain the rights you are entitled to under that agreement and under applicable law, including reimbursement of any amounts already paid. We reserve the right to refuse or cancel orders for valid reasons (e.g. pricing errors, stock issues, suspected fraud).

1. Payment

Payment is required before shipping. We offer various secure payment methods. The available payment options will be shown during checkout. We reserve the right to change or limit payment methods at any time, provided this does not affect orders already confirmed.

1. Shipping and Delivery

Estimated delivery times are non-binding unless explicitly guaranteed. Risk transfers to the buyer upon delivery.

1. Right of Withdrawal (EU 14-day cooling-off period)

As a consumer, you have the statutory right to withdraw from the purchase within 14 days, without giving any reason. This works in two steps:

You have 14 days from the day you receive the product (or, for an order shipped in several parcels, from receipt of the last item) to notify us in writing that you are withdrawing from the agreement, for example by email to info@axiontoolworks.com. You may use the model withdrawal form, which we will send you on request and which is also available via the website of the Dutch government (Rijksoverheid); using it is not mandatory, and a clear written statement is sufficient. You then have a further 14 days from the date of that notification to actually return the product to us.

You are permitted to unpack and examine the product in the way you would be allowed to in a physical shop. If you handle the product beyond what is necessary for this purpose, we may deduct a proportionate amount for any diminished value from your refund; this means that an opened package is not, by itself, a reason to refuse a refund in full.

We will refund the full purchase price, including the standard shipping costs of the original delivery, within 14 days of being notified of your withdrawal, provided that we may withhold the refund until we have received the product back, or you have supplied evidence of having sent it back, whichever is earlier.

The cost of returning the product is your responsibility, unless the product was defective or incorrect, or we have otherwise agreed with you in writing.

Exceptions to the right of withdrawal apply to custom-made or personalized items, perishable goods, and items supplied sealed for hygiene reasons where the seal has been broken after delivery, to the extent permitted by law.

1. Warranty and Complaints

Products are covered by the statutory conformity warranty: the product must meet what you may reasonably expect based on the agreement. For consumers, a legal presumption applies that any defect that becomes apparent within 2 years of delivery already existed at the time of delivery, unless the nature of the product or the defect indicates otherwise, or we prove otherwise. Please report any defect within a reasonable time after discovering it; as a guideline, a report made within 2 months of discovery is considered timely. Where legally required, we will repair or replace the product free of charge, or refund the purchase price (in whole or in part).

1. Liability

Our liability towards you as a consumer is limited to the extent permitted by law. We do not exclude or limit our liability for: damage resulting from death or personal injury; damage resulting from our intent or deliberate recklessness; or the statutory conformity and warranty rights you are entitled to as a consumer under these terms and applicable law (see Section 7). For other damages, including consequential damages, our liability is limited to the amount of the relevant order, unless and to the extent mandatory law requires broader liability.

1. Dispute Resolution

These terms, and any agreements arising from them, are governed by Dutch law. If you reside as a consumer in another EU member state, you continue to benefit from the mandatory statutory protections of the law of your own country of residence, to the extent those provisions offer you a higher level of protection. Disputes may be submitted to the competent court in the Netherlands, provided that, if you reside as a consumer in another EU member state, you retain the right under mandatory law to bring proceedings before the court of your own place of residence, and we may only bring proceedings against you as a consumer before the court of your place of residence.
